By accessing or using our Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. The Service is intended for informational and analytical purposes only and does not constitute legal, financial, or professional advice.
Users must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using our Service, you warrant that you meet these eligibility requirements.
The Service is a paid service. To obtain access, customers must first establish account credentials with BTI. BTI will create a customer account on the Service granting access for an agreed number of individual users.
Users are required to sign in and establish access to their account on the Service. You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities conducted through the account.
Early Preview access or beta access is granted on the understanding that use of the Service may be monitored and data may be evaluated in order to improve the Service.
Preview access is granted on an as-is and as-available basis.
Any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. In no event shall Boston Tech Insights be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this software, even if advised of the possibility of such damage.
You may upload, submit, or provide content, such as interview data and voice recordings to our platform. By doing so, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, and distribute the content for the purpose of providing the Service to you.
You understand that data that you provide will be shared with our external service providers and that use of your data by them will be subject to each of those service providers own Terms and Conditions.
We take data security and privacy seriously. By using the Service, you agree to our Privacy Policy, which outlines how we collect, use, and safeguard your data. We use industry-standard security measures to protect your information but, as for any online platform, we cannot guarantee absolute security.
All intellectual property rights related to our web-based software Service, including the AI algorithms, user interfaces, and report generation mechanisms belong to us. Reports generated from your data become part of your Customer Project Data and are available for your use.
Use is on a non-exclusive basis with the understanding that reports generated for other customers may contain similar or even identical sections to reports generated for you.
You agree not to use the Service for any unlawful, harmful, or malicious purposes, including but not limited to unauthorized access, data harvesting, interfering with the Service's functionality, or infringing on any third-party rights.
We reserve the right if we become aware of any potentially prohibited use to suspend or terminate your use of the Service.
We will release updates or new features from time to time. We will announce such new releases as far ahead as we are able.
We reserve the right to release bug fixes or security fixes to the Service or any part of it at any time without prior notice.
To the extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the Service or any content obtained through it. We do not guarantee the accuracy, completeness, or reliability of the insights or reports generated by the AI.
You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, or expenses arising from your use of the Service or any violation of these Terms and Conditions.
You may terminate your use of the Service at any time. Notification of such termination must be in writing to your BTI account manager.
As noted earlier, we reserve the right to suspend or terminate your access to the Service at any time without prior notice.
These Terms and Conditions shall be governed by the laws of Massachusetts, Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Massachusetts.
These Terms and Conditions constitute the entire agreement between you and us regarding the use of our web-based software Service and supersede any prior agreements or understandings.
